Meet the presenter

Brad-Boertje-10

Brad Boertje, a construction risk management consultant and adjudicator on the Master Builders Association (MBA) North panel.

He is the owner of BorCon, a commercial consultancy which assists Developers, Consultants, Contractors and Sub-contractors to manage the perils of contracting, and the inevitable risks they will encounter.

Brad completed his studies at the University of Natal in 1992 and qualified with a Bachelor of Science in Quantity Surveying.  In 2010 he completed his arbitration studies and became a Fellow of the Association of Arbitrators (South Africa).

He commenced his career working as a Junior QS in the early 90’s and has twice taken up expatriate positions. Firstly, he fulfilled the role of Contract Administrator for the Anglo American Group working on a Greenfields gold mine development in West Africa. Secondly, and some years later after working as a senior QS for Basil Read he was appointed by the listed UK entity, Kier Group PLC, as commercial manager for their Caribbean operations.

More recently, Brad held the role of managing director for a large privately owned South Africa construction company, a position he fulfilled for 10 years before starting his own risk and dispute resolution consultancy in 2018, servicing the needs of all stake holders in the construction industry value chain.

Course Description:

What happens when your client delays your payment, or simply refuses to pay?

You have put in all the effort and time to complete the work, and you have provided the associated services. You have done the work correctly.  You may even have purchased materials and equipment required to complete the work.

You have done what it takes to earn the payment that is due to you.

But, for whatever reason, your client delays your payment, or simply refuses to pay you.

In this course we will share some of the remedies available to you, should you find yourself in a similar scenario.

Our discussion will also include explanations and suggestions on how to manage your risk from the outset, how to set up contracts properly and how to administer them. Furthermore, we will discuss the requirement to first assess the position you find yourself in, then to decide on the best legal and cost-efficient process to follow to recover such funds.
